Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the WorkTime Tracker mobile application ("App") provided by SMILING ATMOSPHERE ‒ LDA, a company registered in Portugal under NIPC 517944596, with its registered address at Rua Capitão Salgueiro Maia, nº 3, 2925-228 Azeitão, Setúbal, Portugal.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

2. Service Description

WorkTime Tracker is a workforce time tracking application that allows:

• Business owners to create workplaces, manage employee schedules, generate QR codes for attendance, view time tracking reports, and manage subscriptions.
• Employees to scan QR codes to record clock-in and clock-out times, view schedules, and receive shift reminders.

3. Account Registration

• You must authenticate using a supported OAuth provider (Google, Apple, or other providers).
• You are responsible for maintaining the security of your account.
• You must provide accurate information and keep it updated.
• You must be at least 16 years old to use the App.

4. User Roles and Responsibilities

4.1 Business Owners

• Responsible for workplace configuration and employee schedules.
• Must inform employees about the use of the App and any location features.
• Must comply with labor laws regarding time tracking.
• Responsible for obtaining employee consent where required.

4.2 Employees

• Must accurately record working hours.
• Must not manipulate time records.
• May enable or disable push notifications.

5. Subscription Plans and Pricing

5.1 Available Plans

Business	Unlimited employees, all features including PDF export, GPS verification, multi-location support

5.2 GPS Verification Add-on

The GPS Verification Add-on is an optional monthly subscription that enables location-based attendance verification. New subscribers receive a 3-day free trial. After the trial period, the subscription is billed monthly.

5.3 Pricing

Subscription prices are displayed in your local currency as determined by Google Play. Prices may vary by country and are subject to change. Current prices are always shown in the App before purchase.

5.4 Payment

All payments are processed through Google Play Billing. By subscribing, you authorize Google Play to charge your selected payment method. We do not process payments directly or store your payment information.

5.5 Auto-Renewal

All paid subscriptions (Starter, Business, GPS Verification Add-on) are auto-renewing subscriptions. Your subscription will automatically renew at the end of each billing period, and payment will be charged through Google Play, unless you cancel at least 24 hours before the end of the current billing period.

5.6 Free Trial

The GPS Verification Add-on includes a 3-day free trial for new subscribers. If you do not cancel before the end of the trial period, your subscription will automatically convert to a paid monthly subscription. You can cancel the trial at any time through Google Play.

5.7 Cancellation

You can cancel your subscription at any time through:

• Google Play Store: Open Google Play → Subscriptions → WorkTime Tracker → Cancel subscription.
• The App: Navigate to the subscription management screen.

Upon cancellation, you retain access to paid features until the end of the current billing period. After that, your account reverts to the Free plan.

5.8 Refunds

Refund requests are handled by Google Play in accordance with Google Play's refund policy. We do not process refunds directly. If you believe you are entitled to a refund, please contact Google Play support.

6. Location Services

The App may request access to your device location only during clock-in or clock-out when the GPS Verification feature is enabled by the business owner.

• No background location tracking.
• Location is used only to verify presence at the workplace.
• The GPS Verification feature is optional and requires a separate subscription.

7. Camera Access

The App uses the device camera exclusively for scanning QR codes at workplace entrances. No photos or videos are captured, stored, or transmitted.

8. Notifications

The App may send push notifications for shift reminders, break reminders, late arrival alerts, and administrative messages. Notifications require user consent and can be disabled in device settings at any time.

9. Account Deletion

• Accounts can be deleted within the App (Profile → Delete Account).
• Deletion is permanent and irreversible.
• Business owners deleting their accounts will also remove all associated workplaces and employee data.
• Employee deletion removes all personal time records.
• Active subscriptions should be cancelled through Google Play before deleting your account to avoid continued billing.

10. Intellectual Property

The App and all associated content, including but not limited to software, design, logos, and documentation, are owned by SMILING ATMOSPHERE ‒ LDA and protected by intellectual property laws.

Users receive a limited, non-exclusive, non-transferable license to use the App for its intended purpose.

11. Prohibited Activities

You agree not to:

• Use the App for unlawful purposes.
• Attempt unauthorized access to the App's systems or data.
• Reverse engineer, decompile, or disassemble the App.
• Interfere with the App's functionality or other users' access.
• Manipulate attendance records or time tracking data.
• Share your account credentials with others.

12. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by applicable law, SMILING ATMOSPHERE ‒ LDA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App, including but not limited to loss of data, loss of profits, or business interruption.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Portugal. Any disputes arising from or related to these Terms shall fall under the exclusive jurisdiction of the courts of Setúbal, Portugal.

15. Changes to Terms

We may modify these Terms at any time. We will notify users of significant changes through the App or by email. Continued use of the App after updates constitutes acceptance of the revised Terms.
